ACCEPTABLE USE POLICY

1.     Introduction

1.1          Whilst Foodstalker has no wish to interfere with your use of the Website and/or use of your Account it must insist that you adhere to and comply with certain fundamental conditions that attach to the lawful and ethical use of the Website and your Account. In particular, it is a condition of your use of the Website and/or your Account that all your activities using the Website and/or your Account comply with applicable law. 

1.2          Accordingly, this acceptable use policy (“AU Policy”) sets out the further terms on which you may access and use the Website and/or your Account. Your use of the Website and/or your Account means that you accept, and agree to abide by, all the policies set out in this AU Policy, which supplement our Website Terms and Account Terms and our Privacy & Cookies Policy. Definitions used in this AU Policy shall have the meaning given to them in our Website Terms and/or Account Terms. This AU Policy is not intended to be comprehensive. Foodstalker may revise this AU Policy at any time by amending this page and use of our Website and/or your Account following such update shall be deemed your acceptance of the updated AU Policy. If you do not agree to the updates then you may discontinue using our Website and/or your Account at any time. 

2.     Account Activity

If you decide to create an Account, Foodstalker may actively monitor your Account activity for behaviour that does not comply with this AU Policy and the Website Terms, Account Terms, and/or Privacy & Cookies Policy (as applicable) (“Non-Compliant Activity”).  If any Non-Compliant Activity is detected, Foodstalker may suspend your Account pending further investigation. 

3.     Content Standards

3.1          Foodstalker insists that any content that you submit to the Website comply with applicable law.
 
3.2          Content must not:
 
(a)           incite, advocate, or express pornography, obscenity, vulgarity, profanity, hatred, bigotry, racism, or gratuitous violence.

(b)           misrepresent the source of anything you post or upload, including impersonation of another individual or entity.

(c)           provide or create links to external sites that violate this AU Policy.

(d)           include content that is protected by intellectual property rights, rights of privacy or publicity, or any other applicable law unless you own or                   control the rights thereto or have received all necessary consents.

(e)           be intended to harm or exploit minors in any way.

(f)            invade anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as passwords,                   account information, credit card numbers, addresses, or other contact information without their knowledge and willing consent.

(g)           be illegal or violate any applicable law.

(h)           threaten, defame, defraud, degrade, victimise or intimidate an individual or group of individuals for any reason; including on the basis of age,                 gender, disability, ethnicity, sexual orientation, race or religion; or incite or encourage anyone else to do so.

(i)            harm or disrupt, or intend to harm or disrupt, another user's computer or allow you or others to illegally access software or bypass security                     on the Website and/or your Account, or servers, including but not limited to spamming.

(j)            attempt to impersonate anyone (including a company or organisation) or erroneously claim or imply (including through omission of fact)                       that you represent a company or organisation. 

(k)           contain or otherwise reasonably be considered as 'junk mail', 'spam', 'chain letters', or 'pyramid schemes'.

(l)            mischaracterise content you post or upload or contain the same or similar content to other content you have already posted.

(m)         attempt to manipulate the services offered by the Website and/or your Account.

(n)           promote any competitors of Foodstalker, disparage the Foodstalker brand, or seek to harm or disrupt Foodstalker operations in any way.

 
3.3          You will not use any metatags or any other “hidden” text utilising any intellectual property rights of Foodstalker without Foodstalker’s prior written consent.

3.4          You will not frame or use framing techniques to wrap the Website within any other third party platform without Foodstalker’s prior written consent. 

3.5          You will not systematically extract and/or re-utilise all or any parts of the Website without Foodstalker’s prior written consent. In particular, you will not utilise any data mining, robots or similar data gathering and extraction tools to extract for re-utilisation or otherwise any part of the Website. You shall not create and/or publish your own database that features all or any part of the Website without Foodstalker’s prior written consent.

4.     Use of the Website and your Account

4.1          In accordance with the Account Terms you must create an Account to use the additional features provided by the Website, namely the ability to comment on the Footage, to engage (when available) in live dialogue with Foodstalker Personnel, and to purchase food or merchandise available on the Website via your Account. 

4.2          Whilst Foodstalker does not wish to unduly restrict your activities whilst using the Website, you will not:

(a)           post, list or upload content or data in any inappropriate category or other areas of the Website;
(b)           circumvent or manipulate Foodstalker’s pricing structure, billing process or fees owed;
(c)           use the Website in any other way which violates applicable law; or
(d)           use the Website or your Account in contravention of any of Foodstalker’s terms of business (including the Account Terms, Website Terms,                       Privacy and Cookies Policy and this AU Policy). 

5.     Foodstalker’s remedies if you breach the AU Policy

5.1          Foodstalker will determine, in its sole discretion, whether you have breached this AU Policy. When a breach of this AU Policy has occurred,                     Foodstalker may take such action as Foodstalker deems appropriate.
 
5.2          Failure to comply with this AU Policy constitutes a breach of your agreement with Foodstalker. As a result of such breach Foodstalker may                     take any or all of the following actions:
 
(a)           Foodstalker may immediately, temporarily or permanently withdraw your right to use the Website, including your Account.
(b)           Foodstalker may temporarily or permanently suspend or terminate any of your activities on the Website, including access to your Account.
(c)           Foodstalker may immediately, temporarily or permanently remove any of your content from the Website.
(d)           Foodstalker may issue a warning to you.
(e)           Foodstalker may issue legal proceedings against you for reimbursement of all costs on an indemnity basis (including reasonable                                     administrative and legal costs) resulting from the breach.
(f)            Foodstalker may take further legal action against you.
(g)           Foodstalker may disclose such information to law enforcement authorities as Foodstalker reasonably feels is necessary.
 
5.3          Foodstalker excludes all liability for actions taken in response to breaches of this AU Policy. The responses described in this AU Policy are not                 limited, and Foodstalker may take any other action it reasonably deems appropriate.
